Why Do I Need an Owner Builder Report?
Owner builders need to obtain a report for two main reasons:
- to fulfil their legislated responsibilities (Building Act
1993)in order to sell their property, and/or
- For obtaining warranty insurance if the work performed is over
$12,000 in value.
When selling a property an owner builder must obtain a report on any
''domestic building work'' done within a prescribed period of six years
from the issuing of the Certificate of Occupancy or Certificate of Final
Completion. This report is inserted into the Section 32, Contract of
Sale as a way of showing the vendor has completed all obligations in
accordance with the Building Act 1993. The purchaser has the option to
void a Contract of Sale at any time if the vendor fails to provide a
report.
Owner builders must provide warranty insurance for any domestic building
work exceeding $12,000. A report must be provided to the insurer before
providing warranty insurance. The report identifies any incomplete work
or defects in workmanship or materials. The warranty policy then
excludes any incomplete work or defects listed in the report. The owner
builder remains liable for any defect or incomplete work not listed in
the report. It is an offence to sell a property with owner builder work
less than six and a half years old without an owner builder report
($10,000 fine).
